Building Amendment Regulations 2009

The Building Amendment Regulations 2009 came into effect on 1 September 2009.

A Regulatory Impact Statement (RIS) was prepared in relation to the then proposed Building Amendment Regulations 2009. Notice of the RIS was published on 22 May 2009 seeking public comment and eight submissions were received.

All submissions received were considered and resulted in a number of minor amendments to the draft regulations.

Why were the regulations prepared?
The Building Amendment Act 2008 amended the Building Act 1993 to:

  • require applicants for registration as building practitioners to provide certain information with their application;
  • require registered building practitioners to give notice to their clients, that the Building Practitioners Board has cancelled or suspended their registration;
  • provide for a two tiered building surveyor system.
What is the purpose of the Regulations?
The purpose of the Regulations is to define those matters required to be prescribed under the Building Amendment Act 2008. The Regulations amend the Building Regulations 2006 to:
  • define the information to be provided at the time of making an application for registration as a building practitioner;
  • define the form of the notices to be provided by registered building practitioners to their clients;
  • specify the qualifications required for registration as a building surveyor (limited); and
  • update references in relation to qualifications for registration of certain other categories and classes of building practitioners.
