How to Make a Planning Decision

This program has been developed to provide greater emphasis and discussion on the principles of making a decision within a council. It is focussed on providing improved outcomes for all parties for the use, development and subdivision of land. The program covers to what extent policies are given weight and the balance of policy and precedents in decision making. It covers the integration of conditions and views by referrals authorities and considerations under related legislation and council strategy plans. The program also critically analyses the exercise of discretion by using various case studies/hypothetical’s and reviewing the role of the council, delegation powers and the importance of settling the dispute. Material submitted to VCAT is also covered particularly identifying what triggers a permit and what should be included in the submission.

Learning outcomes

- understand how to balance conflicting policy and competing interests from different stakeholders
- identify the how much weight should be given to different policies in decision making
- identify the matters that are relevant and not relevant for consents and permits
- make planning decisions based on strategic and policy issues
- achieve improved outcomes by developing planners skills in implementing strategies in the planning scheme
- recognise the benefits of negotiated planning dispute settlements.
Meredith Withers is an experienced planning consultant. She has worked with the State Government on various planning issues including the development of “Planning: a Short Guide”, a key planning publication explaining the Victorian planning system. Des Eccles was until recently a long standing VCAT member in the Planning and Environment list. He is a planning consultant and former academic specialising in statutory planning and planning law.
