The advice of the Priority Development Panel was sought in relation to the ‘called-in’ VCAT application (P754/2005) to review Yarra Council’s decision to refuse a permit for a multi storey mixed use development at 132-172 Smith Street and 63-71 Little Oxford Street, Collingwood (Banco site), and Yarra City Council’s request for Amendment C76 - introducing interim structure plan controls for the Smith Street Precinct - to be approved by the Minister without exhibition.

      Victoria Street East Precinct - Part 1
      Referral of a number of interrelated planning matters that have strategic significance for the achievement of planning objectives for the Yarra River corridor and the Victoria Street Major Activity Centre, including:
      • A request by City of Yarra for interim structure plan provisions to implement the Victoria Street East Precinct Urban Design Framework (Amendment C75).
      • A request by Taras Nominees Pty Ltd (Salta) to rezone land within the precinct to a Priority Development Zone to facilitate the development of the former MFB site and land on the west-side of Burnley Street as a mixed use precinct.
      The PDP process for this referral:
      • A series of workshops and focus groups with Council and Salta during December 2005 to March 2006 to identify and resolve issues, refine development concepts and draft planning scheme controls.
      • Targeted consultation process run by PDP to assist in informing itself and formulating recommendations which included:
        • Three community information sessions, held at the Richmond Town Hall on 30 March, 5 April and 10 April 2006 on the PDP process, the Victoria Street East UDF and the development concepts
        • Written submissions from community and key stakeholders submitted to the PDP by 27 April 2006.
        • PDP Interviews with key stakeholders and community groups in early May 2006.
      • Further workshops and focus groups with Council and Salta during May and June 2006 to respond to issues raised in the submissions, including further refinements to the development concepts and draft planning scheme controls, and a further traffic and transport study for the precinct.

      Jaques Site,1 Palmer Street, Richmond
      In February 2007 the Minister for Planning asked the Priority Development Panel (PDP) to provide advice on how redevelopment of the Jaques Site could be progressed. The Minister asked the PDP to provide advice on the development controls affecting the site and requested the PDP to explore opportunities for affordability and environmental substantiality.
      The PDP provided its advice on 21 June 2007, recommending that:
      • the Minister for Planning prepare, adopt and approve Amendment C96 to the Yarra Planning Scheme;
      • the amendment should vary Schedule 4 to the Development Plan Overlay; and
      • the amendment should make the Minister the responsible authority for assessing and approving the resultant development plan.
      On 16 August 2007 the Minister decided
      • to vary the Schedule to the Development Plan Overlay to establish a clear vision for the site, desired outcomes and matters that need to be addressed, including ESD and housing affordability,
      • that the City of Yarra should retain its status as the responsible authority for the site.
      The Minister also encouraged the Council to work collaboratively with the proponent and other stakeholders to progress the consideration of the development plan without delay. The Minister also indicated that the Council could seek the advice of the PDP on the development plan should it wish to do so.

      The new Schedule 4 does not contain any building envelopes or preferred heights. It is envisaged that any development plan submitted by the proponent will be the subject of community consultation in a process to be managed by the City of Yarra.
